Extended Producer Responsibility (EPR) for Packaging: 2025 Deadlines by State & How Emerger Strategies Can Help

Posted on June 2, 2025

As sustainability and regulatory requirements evolve across the U.S., Extended Producer Responsibility (EPR) for packaging is reshaping how brands manage packaging waste. With 2025 deadlines fast approaching in states like California, Colorado, Oregon, and beyond, it’s essential for brands—especially those in the fishing, outdoor, and consumer goods industries—to prepare now.

At Emerger Strategies, we simplify the EPR process, helping brands navigate complex requirements, ensure compliance, and unlock the business benefits of sustainable packaging.

What Is EPR for Packaging?

Extended Producer Responsibility (EPR) laws shift the responsibility of managing packaging waste from governments and taxpayers to the producers (brands) themselves. Under these laws, brands must:

✅ Register with state agencies or Producer Responsibility Organizations (PROs), such as Circular Action Alliance
✅ Collect and report detailed packaging data
✅ Pay eco-modulated fees that incentivize sustainable design
✅ Meet state-specific deadlines and requirements

The goal? To reduce waste, improve recycling rates, and encourage more sustainable packaging solutions.

2025 EPR Deadlines by State

California (SB 54)

  • July 1, 2025: Circular Action Alliance (CAA) is urging Covered Producers to register with the association by July 1, 2024
  • August 31, 2025: Producers must report data to CAA for all covered material sold in California in 2023.
  • January 31, 2026: Submit report on source reductions of covered materials from Jan-Dec 2025.

Colorado (HB 22-1355)

  • October 1, 2024: Colorado deadline to register with CAA
  • July 31, 2025: CAA preliminary deadline for data reporting
  • January 2026: Producer fees due

Oregon (SB 582)

Maine (S2145)

  • May 2026: Producers register with the SO and report data
